얼마 전부터 닥터 루크는 케샤를 상대로 명예 훼손 소송을 하고 있다. 하지만 케샤는 "anti-SLAPP law"를 앞세워 닥터 루크의 명예훼손 소송을 무효화시키려고 발악 중. 일단 "anti-SLAPP law" 중 'SLAPP'은 "전략적 봉쇄소송"이라고, '힘 있는 자'들이 그들의 비리를 까발리려는 사람들을 입막음 혹은 위축시키기 위해, 비싼 변호사를 앞세워 그들의 비리를 까발리려는 사람들을 고소하는 것. 그리고 "anti-SLAPP law"는 비리를 까발리려는 사람들을 입막음 혹은 위축시키기 위해 진행되는 소송을 아예 없애 버리는 법. 그러니까 케샤는 케샤 보다 돈도 많고 영향력도 있는 닥터 루크가 자신을 입막음하기 위해 명예 훼손 소송을 걸었다고 호소하는 중이었는데... 처음에는 닥터 루크가 불리해보였다. 하지만, 이번 주 케샤를 상대로 한 닥터 루크의 명예 훼손 소송은 "anti-SLAPP law"에 적용되지 않는다,라는 판결=즉, 닥터 루크는 케샤를 상대로 명예 훼손 소송을 계속 할 수 있게 됐다.

그런데 이번 판결은 케샤에게 절대적으로 불리한 것 같다. 이유는 기사를 보니까 닥터 루크가 "anti-SLAPP law"를 벗어나 케샤를 상대로 한 명예 훼손 소송을 계속하려면, 케샤가 단순히 '잘못된 발언' 혹은 '피해를 주는 발언'을 했다는 걸 증명하는게 아니라, 케샤가 "고의로 거짓말을 했다"는 걸 증명해야 했다고 하기 때문. 그리고 닥터 루크는 "anti-SLAPP law"를 격파했으니까, 법정도 케샤가 고의로 거짓말을 했다는 걸 인정해버린 셈 같다. 그래서 이후 진행될 명예 훼손 소송은 닥터 루크가 승리할 가능성이 높아 보인다. 암튼 케샤는 최대한 잔인하고 & 최대한 고통스럽게 징악당했으면 좋겠다!

♬금주의 망한 흑인 게이 : 주시 스몰렛

주시 스몰렛이라는 B급(?) 정도 되는 흑인 게이 배우는 2019년에 다른 사람 2명에게 동성애 혐오 욕설을 들었고, 폭행까지 당했다며, 이를 경찰에 신고했다. 그러자 흑인과 게이는 우선적으로 챙겨야 인기 끌 수 있다고 생각하는 미국 셀럽들은 대거 봉기해서 → 주시 스몰렛에게 저런 짓을 한 범인들을 찾아 내라고 난리를 쳤다. 하지만 조사 결과, 주시 스몰렛에게 욕을 하고 폭행한 두 사람은 주시 스몰렛이 출연한 "미드 Empire"에 출연했던 사람들이었고, 이 사람들은 주시 스몰렛에게 돈을 받고, 주시 스몰렛이 시키는대로 했다고 한다. 그래서 이 사건을 담당하는 경찰은 "거짓 신고로 인한 업무 집행 방해죄(?)", 뭐 이런 걸로 주시 스몰렛을 기소했고, 이번 주에 판결이 났다. 판결은 150일간의 깜빵행과 $120,106의 벌금... 덕분에 흑인+게이라는 이유로 앞뒤 안 가리고 주시 스몰렛을 미친듯이 쉴드친 미국 셀럽들만 나가리 됐다.

♬금주의 다행? : 카디비

카디비는 "Assisted Living"이라는 영화에 주인공으로 캐스팅됐었다. 기사만 보면 이 영화는 코미디 영화 같다. 그런데 카디비가 워낙 바빠서 영화 출연을 취소. 그러면 당연히 다른 배우를 캐스팅해서 영화를 찍는게 일반적인데... 영화 자체를 아예 안 찍기로 했다고 한다. 문제는 이미 이 영화에는 수많은 배우들이 캐스팅되었고, 스태프들도 고용된 상태였다는 것. 그래서 영화가 엎어지면서 캐스팅된 배우들과 고용된 스태프들은 일자리를 잃게 됐다.

여기까지만 보면 카디비가 잘못한게 맞는데, 카디비의 커리어를 생각하면 다행인 것 같다. 왜냐고? 영화 자체가 괜찮았다면 제작자들은 다른 배우를 캐스팅해서라도 영화를 완성해서 개봉했을 거다. 그런데 카디비 한 명이 빠졌다고 영화를 엎었다는 걸 보면, 이 영화는 오로지 카디비의 스타성에 기댄 영화로 밖에 안 보인다. 그리고 내 경험상, 오로지 유명 배우 한 명 때문에 제작이 시작 혹은 중단되는 영화들은 완성도도 개판이고 흥행도 잘 되는 경우가 없다. 그래서 이번 영화에서 빠진 건, 카디비의 커리어를 생각하면 잘 된 일 같다.

-"Heat Waves"를 완성해서 발매하려고 했을때 코로나 바이러스가 터졌다고 한다. 그래서 발매 일정을 최대한 늦췄다고 한다. 이유는 Dave Bayley에 따르면 코로나 바이러스 때문에 사람들은 신곡이 아니라 원래 좋아하던 옛날 노래를 찾아들어서, 신곡을 발매하기에는 좋은 상황처럼 보이지 않았다고 한다.

-"Heat Waves"는 호주싱글차트가 아닌 호주의 라디오 청취자들(?)의 투표로 결정되는 'Triple J Hottest 100'에서 2020년에 1위를 했었다. 그리고 Dave Bayley는 여기서 1위를 해서 엄청 기분 좋았고, 여기서 1위를 했을 때 수년간 연락을 하지 않았던 사람들이 Dave Bayley에게 연락을 해왔다고 한다. 또한 Dave Bayley가 엄청 좋아하던 뮤지션들도 축하한다고 연락해줬다고. 그나저나 "Heat Waves"도 대단한 것 같다. 호주에서는 연말 차트로 보이는 'Triple J Hottest 100'에서 2020년에 1위를 했는데, 빌보드싱글차트에서는 2022년에 1위를 먹었으니...

-"Heat Waves"와 이 노래가 수록된 "Dreamland 앨범"이 나왔을 때 노래와 앨범이 좋았던 리스너들은 노래와 앨범의 커버 사진들을 자기들이 마음대로 만들어서 공개했고, 노래와 관련된 사적인 이야기들도 써서 공개했고, 러그, 신발 같은 걸 노래를 이용해서 장식했다고 한다. 그래서 서양 리스너들은 노래가 좋으면 이런 식으로 자기들이 좋아하는 노래를 응원하는 것 같다는 생각을 하게 됐다.

-"빌보드차트분석 2019년8월3일 글"에서 다루었듯 2008년에 나온 노래="Joyful Noise"의 원곡자(?)는 2013년에 발매된 케이티 페리의 "Dark Horse"가 "Joyful Noise"를 표절했다며, 케이티 페리를 고소했다.

-2019년에 나왔던 1심 판결은 케이티 페리 포함 "Dark Horse"의 저작권료를 받는 사람들과 이 노래로 수익을 올린 회사들이 분할해서, "Joyful Noise"의 원곡자에게 $2.78 million를 물어내라고 했다.

-그런데 이 판결은 음악계에서 엄청 논란이 됐다. 두 곡에 유사한 부분이 있긴 하지만, 유사한 부분의 비중이 너무 적고, 비중이 적은데도 표절이라고 하면, 표절을 하지 않고 노래를 만드는 것 자체가 힘들어진다는 여론이 많았기 때문.

-이번 주에 나온 최종 판결을 보면... 일단 두 곡에서 유사한 부분은 "Merrily We Roll Along(1930년대 발매)", "Jolly Old Saint Nicholas(찾아 보니 19세기에 나온 캐럴...)" 같은 다른 노래들에도 등장한다고 한다. 그리고 "Dark Horse"가 표절이면 "앞으로 송라이터들이 노래를 만들기가 힘들어진다, "Dark Horse"와 "Joyful Noise"에서 유사한 부분은 워낙 일반적으로 사용되는 음계 같은 거라서, 다른 뮤지션들도 아무 문제 없이 무료로 사용할 수 있어야 한다"는 판결이 나왔다. 암튼 이번 판결로 앓던 이가 빠진 것 같은 케이티 페리다.
